The Arkansas Alcoholic Beverage Control Division (ABC) canceled a Hot Springs medical marijuana dispensary’s license on Thursday, this was the first time that this has happened since medical cannabis sales were legalized in the state five years ago.

The owner of Green Springs Medical Marijuana Dispensary, Dragan Vicentic, plans to appeal ABC’s decision to the board. This means the shop can stay open while they sort things out, as per a Department of Finance and Administration announcement.

What were the fines given for?

“The license was revoked due to ongoing violations, including the sale of over 1,800 expired products. Arkansas Alcoholic Beverage Control Division agents made an undercover purchase of these products in October 2023 after a verbal warning regarding the marijuana products.”

ABC fined the dispensary after two inspections last year, according to Vicentic. He argued for a lower fine, saying the problems were understandable.

What did the owner have to say?

He was surprised by ABC’s reaction. Vicentic said, “I thought they would lower the fine because I explained everything, but then they suddenly decided to take away our license, which I thought was too much.”

The Warnings

Trent Minner, who heads the finance department’s regulatory division, stated in the news release that Green Springs had “more than 50 violations and warnings in the past four years.”

“A license to run a medical marijuana business in Arkansas is a special privilege,” Minner emphasized. “When state laws are repeatedly ignored, ABC has the duty to revoke the license.”

Green Springs broke medical marijuana rules in these ways:

  • Didn’t keep processing areas clean.
  • Didn’t meet inventory standards.
  • Didn’t keep accurate staff records.
  • Didn’t have video surveillance.
  • Didn’t use strong locks.
  • Had wrong signs.

In 2016, Arkansas voters approved a change to the constitution that legalized medical marijuana and getting medical marijuana with marijuana card. Apart from Green Springs, the state has 37 dispensaries, the second of which opened in 2019 after being licensed.

The finance department reports that purchases at the state’s dispensaries have totaled $1.1 billion over the last five years.
