The Florida Supreme Court has given the green light for a ballot initiative to legalise the recreational use of marijuana in the state. The ruling on Monday means that voters will have the opportunity to decide on the proposed amendment in November.

If approved, the amendment would allow individuals aged 21 and older to possess, purchase, or use marijuana products and accessories for personal non-medical consumption, whether through smoking, ingestion, or other means. It would also authorise licensed medical marijuana treatment centres and other state entities to cultivate, process, sell, and distribute these products and accessories.

The initiative, which faces opposition from many Republicans, including the state attorney general’s office, will need 60% approval from voters to pass.

Justice Jamie R. Grosshans, in an advisory opinion, stated that the court found the proposed amendment to be constitutional and clear, meeting the necessary requirements.

“Our role is narrow—we assess only whether the amendment conforms to the constitutionally mandated single-subject requirement, whether the ballot summary meets the statutory standard for clarity, and whether the amendment is facially invalid under the federal constitution,” wrote Grosshans, an appointee of Gov. Ron DeSantis. “In light of those limited considerations, we approve the proposed amendment for placement on the ballot.”

Cannabis is currently legal in various forms, either for medical or recreational use, in over 40 states across the country.

Smart & Safe Florida, a sponsor of the initiative, expressed satisfaction with the court’s decision.

“We are pleased that the Court agreed that the ballot language was clear and correctly ruled in favor of allowing voters the chance to vote on this important initiative,” the organization said in a statement.

The attorney general’s office had objected to the proposed ballot measure and asked for an advisory opinion, arguing that the proposal was deceptive.
