Is Medical Marijuana Legal in South Carolina?

South Carolina is one of the few states that does not have a medical marijuana program. But the use of CBD (cannabidiol) was approved on June 2, 2014, when the SC Senate passed S 1035, or “Julian’s Law.” Only patients suffering from epileptic conditions who have not responded to traditional treatment are eligible for medical cannabis containing no more than 0.9% THC and 15% CBD.

Cannabis is illegal for recreational use in South Carolina. One can only access low-THC cannabidiol (CBD) oil for epileptic medical conditions. The possession and cultivation of any form of marijuana are strictly prohibited in the state.

Personal possession of under one ounce of raw marijuana flower is a misdemeanor which may result in one month in jail and a fine of up to $200. Personal possession of more than one ounce of raw marijuana flower results in felony charges.

Cultivation penalties are based on the weight of plants, which can mean mandatory jail time for a single plant.
