Medical marijuana was legalized in the Virgin Islands after 56.4% of residents voted to develop a scheme in a 2014 referendum. The bill for medical use was enacted and signed in 2019 as the VI Medical Cannabis Patient Care Act (MCPCA). It laid out a system whereby residents and non-residents could access medical marijuana with a med card. The marijuana laws in Virgin Islands permit residents to possess up to 4 ounces of marijuana and cultivate up to 12 cannabis plants. Non-residents are allowed up to three ounces. For the medical card, patients must be diagnosed with a qualifying condition by a licensed healthcare professional and apply to the Office of Cannabis Regulation. The bill also made provisions for the licensing and regulation of cultivation, distribution, and caregivers, intending to place the VI at the forefront of the Caribbean wellness industry.

A resident with a medical marijuana card can possess up to 4 ounces, or 113 grams of cannabis, and a nonresident can possess up to 3 ounces, or 85 grams. The bill specifies that non-residents, including residents who have resided on the islands for less than 45 days. However, for recreational users or adults aged 21 and up, it is legal to possess up to 2 oz of cannabis flower. As VI recently legalized the recreational use of marijuana, adult-use sales have not begun yet. If patients have registered for home cultivation, the allowable amounts of cannabis can be “any combination of 12 plants, mature or immature”. Home cultivation is permitted in one shared, enclosed, and locked space.

Residents

To qualify as a resident of the medical marijuana program of VI, you must live in the territory for 45 days. For residents, VI medical marijuana card costs $50 for one year.

Nonresidents

If you have been in the VI for less than 45 days or plan on coming to the VI as a tourist, you can also get marijuana treatment. Nonresidents must pay $50 for a five-day card, $75 for a ten-day card, or $100 for a 30-day card.

Nonresident Outpatients

If you have been in the Virgin Islands for less than 45 days but are under the supervision of a doctor, you can qualify as an Outpatient. The doctor must be licensed in the USVI. This is for patients wishing to come to the Virgin Islands for marijuana treatment that may not be accessible in their state or country. The cost is the same as the nonresidents.

Anyone over the age of 21 who has agreed to assist patients with the use of marijuana can become a caregiver in USVI. After a caregiver is registered with the OCR, they may grow and purchase cannabis for patients. To be qualified as a patient’s caregiver must:

• Be 21 years old or older;
• Agree to undertake responsibility for managing the treatment plans and well-being of the patient.
• Not be convicted of the illegal sale, manufacture, or distribution of a controlled substance.

A caregiver may only assist a maximum of 3 patients, including themselves. However, they may treat more patients unless a caregiver works for a healthcare facility.

The U.S. Virgin Islands’ marijuana laws allow out-of-state patients to qualify for Virgin Island’s medical marijuana program. Visitors to the U.S. Virgin Islands may use medical cards issued in other jurisdictions to obtain a temporary med card. They may also get a physician’s recommendation and apply for a temporary card.
