Governor’s Executive Order 2022-798 On Medical Cannabis (January 1, 2023)

It is essential to remember that medicinal marijuana is not legal in Kentucky, and the Governor’s recent executive order solely refers to pardons for those in possession of medicinal marijuana, not to the legality of possessing or using medical cannabis.

According to the executive order, individuals must present documentation showing that they have been diagnosed with at least one of the qualified conditions listed in the executive order and that they have a real relationship with the health professional. However, this does not mean owning or using medicinal marijuana is legal in KY.

Qualifying Conditions for Kentucky Medical Cannabis Card

Caregiver in Kentucky

The order applies to a caregiver who is 21 years of age or older and has considerable responsibility for the well-being of the person for whom the caregiver legally purchased medicinal marijuana. If in possession of medicinal marijuana, the caregivers must have a written document proving that they are the person’s caretaker. The patient’s parents or legal guardians do not require this written document.

Possession of Marijuana

The order pardons anyone charged with marijuana possession under KRS 218A.1422 on or after January 1, 2023. The order only applies to medicinal marijuana possession of 8 ounces or less.
