Is Weed Legal in Alabama?

Alabama has recently joined the list of US states that have legalized medical marijuana. Despite that, the recreational use of weed is illegal.

In 2014, Governor Robert Bentley signed Carly’s Law, which permits the University of Alabama at Birmingham to provide non-psychoactive CBD oil of up to 3% THC to children with debilitating seizures as a clinical study.

Governor Bentley signed Leni’s Law in 2016. It expanded Carly’s Law to include any individual with a debilitating disease or conditional seizures.

In 2021, Governor Kay Ivey signed Senate Bill 46, the Darren Wesley ‘Ato Hall Compassion Act‘. The bill allows the use of marijuana with a recommendation for treating approximately 15 qualifying conditions.

Note: Alabama’s medical cannabis program (monitored by AMCC) is under development. The state is not registering patients or caregivers at the moment.

Beginning September 1, 2022, the Commission will start to accept medical cannabis business applications. Once awarded the licenses, physicians may open the certification process to recommend medical cannabis to qualified patients.

Qualifying Conditions for Alabama Medical Cannabis Card

Possession and Cultivation in Alabama

  • Adult patients – can possess no more than 70 daily dosages of medical marijuana for adult registered qualified patients.
  • Minor patients – can possess medical marijuana with a potency lesser than 3% THC.
  • Non-patients – possessing any amount is punishable with a fine of up to $6,000 or jail time of up to one year.
  • Cultivation – patients, caregivers, or residents are not permitted to grow marijuana. If found guilty, one might face imprisonment of 2 to 10 years along with a fine of up to $30,000.

Prerequisites for Registration with the State

  • Must be a resident of Alabama state,
  • 19 or older if registering for self,
  • Certified by a registered physician practicing in Alabama,
  • Has a qualifying condition according to AMCC.

Caregiver in Alabama

The state demands a designated caregiver if the patient is under 19 or disabled (physically or mentally). A caregiver must be 21 or over and be a resident of Alabama. To assist a patient with medical marijuana, a caregiver should register with the statewide medical marijuana program along with the patient. Usually, a parent or a legal guardian serves as a caregiver. According to the law, a caregiver can possess and purchase medical marijuana on behalf of the patient, but it is illegal for them to consume the dosage.

Reciprocity in Alabama

Since the medical marijuana program is yet to be operational, there is no definite information on whether Alabama accepts out-of-state cards. However, once the state begins the application process, we will be able to update. So now, we may consider that Alabama does not have reciprocity.
